E-Pack Rules and Restrictions

Neat Group Corporation and its affiliates are collectively referred to as the "Companies," "we," or "us." The following constitutes the Rules and Restrictions (collectively, "Package Rules") that apply to the products and services (hereafter, "Vacation Package(s)" or "Package(s)") made available to you. These Package Rules are in addition to all other applicable tariffs, contracts of carriage, rules, regulations, policies, the Terms of Use of this Web site (this "Site"), and any other terms and conditions. The Package Rules are subject to change without notice and they govern your use of this Site (the "Agreement"). PAYMENT CONSTITUTES FINAL ACCEPTANCE OF THE FOLLOWING PACKAGE RULES. The Companies reserve the right to amend these Package Rules at any time without prior notice. If we do amend the Package Rules, the amended terms will be effective when posted on this Site.

Vacation Packages

All goods and services that you reserve and purchase in a Package are being sold to you directly by the suppliers of those goods and services (the "Suppliers"). A Supplier is an airline, hotel, car rental company, any entertainment venue, tour company, restaurant, or other provider of goods or services of a particular Package item or component. In addition to the Package Rules contained in this Agreement, your reservations and purchases are also governed by the terms and conditions of the respective Suppliers. Any claims that you may have with regard to the goods and services purchased or reserved through this Site must be addressed to the Supplier. You expressly release us, its subsidiaries and affiliates, and each such party's respective officers, directors, agents, contractors, or employees, from any and all liability for, resulting from, arising out of, or in any way connected with, any goods or services contained in any Package. You agree to abide by the terms and conditions set by each Supplier, including, but not limited to, observation of check-in/check-out times and compliance with all other Rules and Restrictions related to fares, products, or services. Depending on the individual Supplier, frequent traveler points may or may not be available for any component of a Package. Our Packages must include at least one (1) overnight stay and two (2) travel components (air transportation, hotel accommodations and/or ground transportation). Vacation Packages can include up to 4 people, including infants and children, but must include at least one adult over the age of 18.

Prices and Availability

Package price depends upon selected day of departure, departure city, and class of airfare, if applicable. Prices displayed are in U.S. Dollars and are per person, based on double occupancy. All offers are subject to availability and are limited, so all prices and dates may not be available at the time of booking. Additional restrictions may apply, and all information is subject to change without notice.

Prices and availability are valid only in conjunction with a Package in its entirety and do not apply to any single component standing alone. All Package prices and components are subject to change until paid in full and a confirmation e-mail message has been sent. Package pricing will not be changed after payment, nor shall a subsequent price reduction be made retroactive. Prices are subject to change for events beyond control of the Companies and include, without limitation, increases in fuel, third-party surcharges, departure taxes, tariffs or passenger facility charges.

Exclusions and Additional Charges

Unless otherwise expressly listed as part of a Package, the Package prices displayed on this Site do not include items such as meals, shows, tours, gratuities, telephone calls, cribs, rollaway beds, infant car seats, liquor, laundry, guest incidentals at hotel or other items of a personal nature not otherwise specified in the quoted prices. Prices may also exclude some fees and surcharges such as resort fees and energy surcharges. Additional charges may apply to the items or services not included in the Package. You are solely responsible for any such additional charges due a Supplier; if you have any questions about such charges, please contact the Supplier directly.

Payment

Payment in full must be made with a credit card at the time of booking your reservation. You authorize the Companies or an authorized third party to charge the credit card that you provide for the total amount of purchase. You may be required by a Supplier to present a credit card at the time of check-in, rental, or pick up to provide confirmation of authorized card use or to secure any additional charges. The cardholder must be a traveler listed on the reservation.

Discounts and Promotions

Except for promotions specifically offered for or by the Companies, no other promotional discounts, upgrades, vouchers, coupons, frequent traveler awards, gift certificates or other discounts or special offers apply to a Package or any components thereof.

Cancellations and Changes

Most components (airfare, rental car and/or hotel accommodations) do not permit itinerary changes/cancellations/refunds; in those cases where a Supplier will permit changes, you will be charged change/cancellation/refund fees which could range from 10%-100% of the total vacation package price. Changes or cancellations must be for the same number of persons traveling under, and the identical person(s) named on, the original itinerary selected. No refund will be given for unused or partially used package components. Additional airline, hotel and/or rental car charges incurred as a result of a permitted schedule change/cancellation are not included in a package price.

If the Supplier you select does permit a change or cancellation, fees for permitted changes/cancellations will vary based on Supplier rate rules, rate type, date of change/cancellation request, dates of travel, etc.:

  1. In most cases, an issuing airline carrier will require you to change/cancel your itinerary prior to your flight, as originally scheduled and to pay a change/cancellation/refund processing fee, including any applicable increase in airfare amount for a re-scheduled flight (the amount will vary by market, dates, the issuing carrier, and your specific airfare rules). Residual values are not refundable should the new fare be lower than the original.
  2. In most cases, a rental car and/or hotel supplier will require you to change or cancel your itinerary prior to your travel, as originally scheduled, and/or to pay a change/cancellation penalty.

In addition, the Companies assess a $45 per package non-refundable fee to process any permitted change/cancellation.

Travel to International Destinations

You are responsible for ensuring that the name/names on the reservation exactly match their proof of citizenship for travel purposes. This includes, but is not limited to, use of nicknames and maiden versus married names for female travelers. For air travel with an origin or destination outside the United States, all travelers are required to show a valid passport as proof of citizenship. In some instances, a birth certificate plus a government-issued picture identification card may be sufficient if traveling by land or sea. However, passports will also be required for land/sea international travel as early as January 1, 2008. Consult your Supplier, local consulate or embassy and/or the Travel Advisory Section of the U.S. State Department for specific requirements. The Companies are not responsible for denied boarding due to problems with visas or passports.

Infants (children under two years of age at time of travel) must have an airline ticket for international travel. If you are traveling with an infant, contact your airline directly to purchase a ticket for your infant.

To ensure enjoyable travel to international destinations, learn as much as possible about the country(ies) you intend to visit. In addition to library books, brochures, country Web sites, etc., we encourage you to visit the U.S. Department of State Web site at www.state.gov.The Companies have no special knowledge regarding the suitability for disabled persons of any Package products offered by Suppliers, and no special knowledge regarding unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.

Airline Ticketing, Taxes and Fees

All airline tickets will be issued as electronic tickets. Airlines specify that all tickets are non-transferable and name changes are not allowed. Where the entire itinerary is within the U.S., all travelers 18 and older must present government issued photo identification that matches the name on this itinerary. If your origin or destination is outside the US, please see Travel to International Destinations. You are responsible for entering the names of the travelers correctly during the reservation process.

All passenger air transportation is subject to the terms and conditions of the tariffs, contracts of carriage, rules, regulations, policies, terms and conditions (including Warsaw Convention notices) of the operating airline. Minimum check-in times may apply. In the event of a delay or cancellation, the airline is solely responsible for determining and providing compensation, if any, to the passenger(s).

Baggage Fees

Additional baggage charges may apply.

Vacation packages including airfare may include, as applicable, one or more of the following: (i) airport Passenger Facility Charges that range from $2-$18, depending on itinerary; (ii) Federal Segment Fees of $3.60 per segment for tickets issued on January 1, 2009 and beyond (defined as a takeoff and a landing); (iii) the September 11th Security Fee of $2.50 per flight segment (maximum per trip of $5.00 one-way or $10.00 roundtrip; (iv) a Travel Facilities Tax of up to $14.60 per roundtrip for domestic flights beginning or ending in Alaska or Hawaii; (v) for fares to Canada, a federal immigration fee of $7.00 per roundtrip, airport fees of $6.50 per roundtrip and Canada Air Traveler Security charge of CAD7.94 one-way and CAD15.80 round-trip if subject to GST. CAD8.42 one-way and CAD16.84 if not subject to GST; and (vi) for international itineraries, foreign and U.S. government-imposed charges of up to $400.00 per roundtrip, depending on routing and destination. These fees are subject to change at any time, without notice.

The Air component portion of this package may be charged separately by the airline. This means two charges may appear on your credit card; the total of the two charges will equal the total Vacation Package price.

Please contact your airline(s) at least 48 hours in advance to check for schedule changes.

Car Rental

The minimum rental period is for one day and each car rental day in a Package consists of a 24-hour period beginning when the car is picked up. No refund will be made for unused rentals, unused or partially used days. Additional charges may apply if the rental car is returned beyond the 24-hour period. Car rental includes charges for one primary driver. Additional drivers may incur a fee. Any additional charges incurred must be paid directly to the car rental company. Fuel, optional collision damage protection, airport imposed taxes/fees, overtime and drop-off charges, additional driver or young renter's fee, children's safety seats, and other optional items, if any, are extra. Some airports impose a tax or fee if you choose to exit on a shuttle bus. Additional charges may apply if a rental car is not returned to the city where it originated. The minimum age for renting a car is 25 years. Suppliers may also impose limitations on the areas, states or countries where the vehicle may be driven. It is your responsibility to confirm age eligibility and permissible driving area directly with the supplier prior to purchase.

All renters are required to have a valid driver's license and major credit card in their name. The person indicated in the Primary Adult field will be designated as the primary driver. Suppliers reserve the right to refuse any request for rental. All renters must meet standard age, driver, credit and cash rental requirements of the respective Supplier. Driving records may be checked. At the time of rental, drivers must present a valid driver's license and may be subjected to an electronic Department of Motor Vehicles (DMV) check with the issuing state department of motor vehicles. In addition, the driver must provide a valid credit card in his/her name at time of booking the car rental reservation. Credit cards with less than $300.00 available credit will not be accepted (available credit amount may vary and is subject to change without notice); debit cards will not be accepted. If you purchase this Package with a debit card, a valid credit card will still be required for car pick-up.

Credit card companies offer cardholders varying degrees of coverage providing the customer uses their charge card for the rental and declines the optional coverage offered by the car company at time of rental. Some credit card companies do not provide their standard coverage for pre-paid packages since the consumer card does not directly pay for the car rental. Please check with your credit card company if you are relying on this coverage. Coverage will vary so be sure to check specifics with your credit card company prior to the rental. If you choose to decline the car rental company's coverage, you will be responsible for the full value of any damage to the vehicle. Should an accident or damage to the vehicle occur, check first with your personal car insurance carrier before filing a claim with your credit card company.

Hotel

Hotel bed types and non-smoking rooms are not guaranteed and will be assigned at check-in based on availability. Hotel property amenities are subject to change without notice and at the discretion of the hotel. Hotel Photos are representative only and do not necessarily depict the actual room in which guests will be accommodated. Minimum age restrictions may apply for hotel check-in. You must be at least 21 years of age to check-in at a hotel with a casino. To check into a hotel, there must be at least 1 adult over the age of 18 per room, except where state law provides otherwise.

Price does not include incidental hotel charges such as room service, telephone calls, etc. Please present a credit card for incidentals upon hotel check-in.

Possible Changes in Itinerary

If the Supplier provides us adequate notice of a change in a scheduled itinerary, we will use good faith efforts to notify you; however, the Companies are not liable for any changes in a reservation that are beyond our control and are caused by, due to, or are attributable to a Supplier. No refund will be given for unused or partially used components due to an airline schedule change. Additional hotel and/or car charges incurred due to schedule changes are not included in the Package price.

Traveling with Children

All Packages purchased must include at least one adult age 18 or older. No child under the age of 18 will be allowed to travel or check-in at a hotel unless accompanied by an adult. It is the Purchaser's responsibility to confirm age eligibility.

Responsibility

The Companies make arrangements with third party vendors for tour and Package services and accommodations, including air transportation, lodging, and car rental. The Companies are not an agent of the customer or of the other parties providing travel related services. By using this Site, the customer waives any claim against a Company, its subsidiaries or affiliates, and any of such party's officers, directors, agents, contractors, or employees, and expressly agrees that neither Company nor any of its subsidiaries, affiliates, officers, directors, agents, contractors or employees, shall be held liable for a) any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act of omission of, or any failure of performance of any kind by any other transportation company, vendor, or Supplier; b) any inconvenience, loss of enjoyment, mental distress or other similar matter; c) any delayed departure, missed connections, substitutions of accommodations, terminations of service, or changes in fares and rates; d) any cancellation or double booking of reservations or tickets beyond the reasonable control of a Company; and e) any claim of any nature arising out of or in connection with air or other transportation, services, or other features performed or occurring in connection with any Package component.
